Falling box leads to suit against Lowe's

HUNTINGTON - A Kanawha County couple has filed a personal injury suit against a national home improvement center after the woman was injured when a box fell on her at the store.

Melinda and Doug Taylor filed a suit June 21 in Kanawha Circuit Court, against Lowe's Home Centers Inc. after Melinda Taylor was injured at one of the retailers' South Charleston location.

The suit also names a Jane Doe as a defendant.

The suit states Melinda Taylor was shopping at the Lowe's warehouse in South Charleston when a box that fell from an overhead shelving unit struck her. Taylor claims the accident was caused by the careless negligence of the Jane Doe.

As a result of the accident, Taylor suffered medical expenses, and pain and suffering. Doug Taylor also claims he suffered a loss of spousal consortium, as well as other damages.

According to the lawsuit, Lowe's failed to train their employees on how to safeguard customers while stocking and retrieving merchandise from overhead shelves, therefore the company is negligent.

The Taylors seek compensatory and punitive damages. Attorney Robert Cline is representing the couple.

The case has been assigned to Judge Charles King.
