Wheelchair-bound man sues after being hit by truck

CHARLESTON - A disabled Kanawha County man filed a suit against a man who hit him with a truck while he was traveling in his wheelchair on a Charleston road.

Chad Beam filed a suit Oct. 16 in Kanawha Circuit Court, against Gregory McCloud. Beam, who is in a wheelchair, claims he was traveling on Capitol Street on March 4, 2006, when McCloud stuck him at the intersection of Capitol Street and Virginia Street East.

According to the suit, McCloud, driving a 1998 Chevrolet S-10, was intoxicated and driving the wrong way on Capitol Street.

On March 9, 2007, Kanawha County Magistrate Carol Fouty convicted McCloud of a hit and run and a DUI causing injury. McCloud was sentenced to one year of home confinement.

Beam claims he suffered severe injuries and damages, including physical and emotional injuries, medical treatment, pain and suffering, aggravation and inconvenience, loss of enjoyment of life and other consequential damages.

In the two-count suit, Beam seeks compensatory and punitive damages.

Attorney Tim C. Carrico is representing Beam. The case has been assigned to Judge Irene Berger.
