CHARLESTON - A Roane County man has filed a suit against a local pharmacy after he passed out after being given a larger dosage of medication than he was prescribed.
Edmond Hall and his wife Anna Hall filed a suit Oct. 30 in Kanawha Circuit Court against Clendenin Pharmacy Inc.
According to the suit, Edmond Hall went to the pharmacy April 9, 2007, with a prescription for a 75mg Duragesic patch. Hall claims he put on a patch, as prescribed, then went driving.
"(Hall) was operating a motor vehicle when he passed out, lost control of his motor vehicle and drove into a creek, severely injuring himself," the suit says.
Hall suffered injuries to his head, neck and back and was airlifted to Charleston Area Medical Center, where he was hospitalized.
According to the suit, Hall was given a 100mg patch instead of the 75mg he had been prescribed.
Hall claims he has suffered serious and permanent injuries, great pain and mental anguish, has been deprived of his capacity to enjoy life, has incurred medical expenses, and will incur medical expenses in the future.
Anna Hall claims she has been deprived of the consortium, society and comfort of her husband, both temporarily and permanently.
Together, the Halls seek damages adequate to compensate them for their injuries and claims.
Attorney William M. Tiano is representing the Halls. The case has been assigned to Judge Jennifer Bailey Walker.
