* Kohl claims the defendant was negligent when she was shopping in the Martinsburg Wal-Mart on Nov. 5, 2005, when she tripped and fell over an empty pallet and injured her knees. She claims the store's management should have known about the hazard, and she is seeking damages to be determined in a jury trial.
