MARTINSBURG - A Virginia man has filed a suit on behalf of the estate of his mother, seeking $1.25 million from a man who crashed into her vehicle.
Curtis Power III filed a suit Nov. 19 in Berkeley Circuit Court on behalf of the estate of Charlene S. Power, who died Dec. 13, 2006. The suit is against David Starks and D & L Utilities Inc.
According to the suit, Charlene Power, a Berkeley County resident, was driving her 1995 Ford Taurus on W.Va. 9, on Nov. 28, 2005. At the same time, Starks was operating a 2000 Ford F-150.
Power was preparing to make a left turn, when Starks allegedly failed to stop and crashed into the rear of Power, pushing her car across the centerline and into oncoming traffic, where it was struck again by another vehicle.
According to the suit, Starks followed too closely, failed to keep a proper lookout and failed to maintain control of his vehicle.
Power suffered permanent injuries, endured great pain, mental and emotional suffering and loss of enjoyment of life. She spent vast sums of money for medical care in an effort to heal, treat and cure the injuries she sustained.
As a result, Curtis Power III seeks $1.25 million for the estate of Charlene Power.
Attorney James J. Matzureff is representing Power. The case has been assigned to Judge Gray Silver.
