Vicki Lynch v. Chris Lockard and Omnicare ESC
PA- Jacques R. Williams; Judge Russell M. Clawges, Jr.
* Lynch was employed by Omnicare in Clarksburg. In March 2006, Omincare was purchased by Neighborcare Pharmacy. Lynch was told she would be their new purchasing manager. Once she took over the position, she claims she was subjected to discriminatory treatment, intimidation, manipulation and ridicule from Lockard, the executive director of Neighborcare. Lynch claims she was treated differently than the male co-workers. Lynch believes Lockard underminded her authority by insulting and intimidating her in front of co-workers. She complained to the company's Corporate Compliance Hotline and notified the company's human resource director hoping the situation would be corrected. Lynch quit in July 2008 claiming intolerable working conditions existed. Lynch is seeking past, present and future loss of wages, mental anguish, medial expenses, compensatory and punitive damages.

On Oct. 27, 2008, before any action was taken on the transfer, Huggins was injured while on the job. As a result, he has been temporarily totally disabled. He received a notice from his employer's health group advising his employment had been terminated in November of 2008 and, therefore, had no insurance coverage.
