Couple sues Huntington surgeon for woman's problems

HUNTINGTON – A woman and her husband have filed a lawsuit in Cabell Circuit Court against a doctor who performed a surgery to help with a pelvic condition that they say caused the woman to suffer adverse effects.

Bonita and James Campbell filed a lawsuit Aug. 27 in Cabell Circuit Court against Dr. Mitchell E. Nutt.

The plaintiffs sued Nutt over an alleged botched anterior and posterior colporrhaphy he performed on April 25, 2007.

During the surgery, Nutt inserted an Avaulta Anterior and Posterior Biosynthetic Support System. The product is a type of surgical mesh used to keep pelvic organs in place in women suffering from pelvic organ prolapse -- a condition that can follow childbirth or surgery.

Nutt operated on Bonita Campbell a second time on June 20, 2007, to revise his first surgery and to reconstruct the urethra, according to the complaint.

Again, on Sept. 10, 2007, Nutt performed a third surgery on Bonita Campbell to close her urethrovaginal fistula, to place a transobturator urethral sling and to repeat the posterior colporrhaphy, the suit states.

Nutt performed many similar surgeries during which he implanted the Avaulta support system in women throughout the Huntington area.

Many of those women have since filed lawsuits against the New Jersey Company C.R. Bard that developed the product.

But the Campbells filed suit against Nutt, saying his treatment of Bonita Campbell has caused her to experience significant mental and physical pain and suffering, permanent injury, physical deformity and loss of a bodily organ system.

Bonita Campbell says the product has interfered with physical relations with her husband.

James Campbell is seeking damages for loss of consortium, companionship, society, affection, services and support.

"Dr. Nutt's care and treatment of Plaintiff Bonita Campbell deviated from the standard of care of the medical profession generally under like or similar circumstances, and was negligent," the suit states.

The Campbells are seeking punitive damages and compensatory damages on counts of negligence and loss of consortium, plus costs, attorneys' fees, interest and other relief to which they are entitled.

Derrick W. Marsteller of Marsteller Law Offices in Huntington will be representing the Campbells.
