Concrete company sued for failure of payment

CHARLESTON -— A forming and shoring company is suing a concrete company for failing and refusing to payment.

Waco Formworks entered into a contract with DNS Concrete and agreed to provide certain equipment, materials and supplies on credit, according to a complaint filed in Kanawha Circuit Court Oct. 13.

Waco Formworks claims that despite complete contractual performance on its part and several attempts to collect payment, DNS Concrete failed and refused to pay them for the use of their equipment, materials and supplies.

According to the suit, DNS Concrete breached its contract with Waco Formworks by failing to pay the amount of $8,531.73.

The company is suing for the principle amount of $8,531.73, plus damages of $611.72. Mary K. Prim of Johnstone, Gabhart & Prim is representing the company.

The case has been assigned to Circuit Judge Louis Bloom.
