CHARLESTON —- A former employee is suing Bone & Joint Surgeons for wrongful termination.

Richard L. Martinez worked for Bone & Joint Surgeons for approximately 30 years, according to a complaint filed Oct 22 in Kanawha Circuit Court.

Martinez claims he was willfully, maliciously and unlawfully discharged on Sept. 19, 2009, because of his age.

According to the suit, Bone & Joint Surgeons violated the West Virginia Human Rights Act.

Martinez is suing for punitive damages for lost wages and benefits; back pay, front pay and overtime pay; and annoyance, inconvenience, indignity, embarrassment and humiliation. Mark A. Atkinson of Atkinson & Polak is representing him.

The case has been assigned to Circuit Judge Irene C. Berger.
