Loan company sues Huntington store for breach of contract

HUNTINGTON -- A loan company is suing Le CookStore Huntington and two individuals for breach of contract.

Le CookStore Huntington received, executed and delivered a promissory note, promising to pay Zone Loan a sum if $175,000 on Aug. 11, 2006 and have yet to pay them the full amount, according to a complaint filed Oct. 23 in Cabell Circuit Court.

The two individuals, Gregory E. and Mary Hanner, executed a commercial guaranty, also on Aug. 11, 2006, guaranteeing payment, according to the suit.

Zone Loan claims that as of Oct. 22, the balance due and owing on the promissory note is $174,384.16.

Zone Loan is suing for the amount of $174,384.16, together and with late charges and with interest at the contract rate until judgment is entered, and then at the legal rate from the date of judgment until paid in full. Casey W. Baker from Huddleston Bolen is representing the company.

The case has been assigned to Circuit Judge F. Jane Hustead.
