CHARLESTON -- A man and his wife are suing Charleston Area Medical Center, a physician and five defendants for Heparin after he was prescribed Heparin in 2007.
The six Heparin defendants are Baxter Healthcare Corp.; Baxter International, Inc.; Scientific Protein Laboratories, Inc.; Changzhou SPL Company, LTD.; and American Capital LTD.
James Bradley was injected with Heparin on Nov. 11, 2007, and suffered an immediate reaction, resulting in debilitating and disabling injuries, including the loss of his toes, which had to be amputated, according to a complaint filed Nov. 10 in Kanawha Circuit Court.
Bradley claims he suffered severe physical and mental pain and suffering.
Heparin was defective and not reasonably fit, suitable or safe for its intended purpose and/or its foreseeable risks exceed the benefits associated with its design and formulation, according to the suit.
Bradley claims Dr. Geoffrey R. Cousins, a surgeon, prescribed, delivered, injected and supplied Heparin to him.
Bradley and his wife, Shirley A. Bradley, are suing for compensatory and punitive damages for product liability –- defective design, product liability -– failure to warn, consumer fraud, breach of express warranty, tort of malpractice and loss of consortium. They are being represented by Shannon M. Bland and C. Page Hamrick.
