* The Nulls and the Isons claim Kenova had a combined sewage and waste water runoff system for many years until it was pressured by the Environmental Protection Agency to separate them. Ghosh was contracted to design and supervise the new systems, and Rover and Eastern participated in the process, according to the suit. The plaintiffs claim the result of torrential rains was backflow of runoff and sewage water onto both of their properties. They are seeking compensatory damages and for the court to issue a rule for a writ of mandamus to require Kenova to repair and rectify the current problems with the systems.
