Two mothers sue Cabell school board, bus driver for sons' deaths

HUNTINGTON -- Two parents are suing the Cabell County Board of Education and a school bus driver in separate lawsuits after their sons were killed in a vehicle accident.

On Dec. 11, 2007, Robert Wayne Sinclair and Christopher S. Adkins were passengers in a car driven by David Allen Adkins that was struck by a school bus, according to separate complaints filed Dec. 10 and Dec. 11 in Cabell Circuit Court.

The school bus was driven by David Shawn Gibson.

The women claim the school board is responsible because Gibson was acting in the scope of his employment and that the Board was negligent in hiring, training, supervising and retaining Gibson as its employee.

Both sons were fatally injured and died at the scene of the accident. David Allen Adkins died later at St. Mary's Medical Center.

Both women are seeking compensatory and punitive damages for their sons' wrongful deaths. Michael S. Bailey and Gregory L. Howard of Bailey & Howard are representing Mrs. Sinclair. Mrs. Adkins is being represented by J. Robert Leslie of Tyree, Embree & Leslie.

Mrs. Sinclair's case has been assigned to Circuit Judge F. Jane Hustead. Mrs. Adkins' case has been assigned to Circuit Judge David M. Pancake.
