* Miller is petitioning a writ of prohibition against Greenberg, a family court judge, from an order entered on Nov. 6 following an evidentiary hearing held Oct. 29. According to the complaint, the Family Court was without jurisdiction and exceeded legitimate powers when it ordered the dissemination of certain privileged documents, a memorandum of understanding and a copy of an unrecorded deed, belonging to a non-party under alleged disability. At issue is the attorney-client privilege belonging to Elizabeth Small, the 95-year old grandmother of the petitioner, who serves as his grandmother's attorney-in-fact. The petitioner is requesting a Writ of Prohibition to the Family Court of Jefferson County to vacate the Nov. 6 Order and prohibit the Family Court from enforcing or making any ruling regarding the ownership of land of Elizabeth Small.
