CHARLESTON -- Cecil I. Walker Machinery Company is suing a Putnam County company and its president for failure to pay over $300,000.
On Feb. 27, 2007, Waste-Tron entered into a contract with Walker Machinery for the purchase of 10 pieces of heavy equipment, according to a complaint filed Dec. 22 in Kanawha Circuit Court.
Walker Machinery claims Paul Saluja, president of Waste-Tron, executed a note as co-maker with Waste-Tron for the purchase of the heavy equipment. The unpaid balance was due and payable in full on Feb. 27, 2009, but the defendants defaulted on the note.
Waste-Tron and Saluja owe Walker Machinery the payoff amount of $122,066.55, according to the suit.
From Jan. 15 until Oct. 30, 2009, Waste-Tron maintained an open account with Walker Machinery and was provided with various services, parts and rental equipment, according to the suit.
Walker Machinery claims Waste-Tron's balance in its open account with the company totals $226,218.71.
Walker Machinery is seeking damages in the amount of $122,066.55, plus pre- and post-judgment interest for the heavy equipment, and $226,218.71, plus pre- and post-judgment interest for services, parts and rental equipment. The company is being represented by Julia A. Chincheck, J. Mark Adkins and Jeffrey M. Shawver of Bowles, Rice, McDavid, Graff & Love.
Waste-Tron has been named as a defendant in several similar suits in Putnam County.
The Walker Machinery case has been assigned to Circuit Judge Paul Zakaib Jr.
