Woman sues Division of Corrections, two individuals for sexual harassment

CHARLESTON -- A woman is suing the West Virginia Division of Corrections, an unknown person and an employee of the WVDC for treatment she allegedly endured while incarcerated.

Jessica Legg claims during her incarceration in Anthony Correctional Center, she was sexually harassed, sexual abused and sexually assaulted from 2005 until 2009 by Billy Jack, according to a complaint filed Jan. 6 in Kanawha Circuit Court.

Legg claims she has suffered anxiety; humiliation; annoyance and inconvenience; invasion of privacy; emotional distress; pain and suffering; mental anguish; loss of her ability to enjoy life; future medical and pharmaceutical expenses; and other damages.

According to the suit, the West Virginia Division of Corrections was negligent in failing to supervise, train and hire Jack and an unknown person; negligently staffed the correctional center; negligently failed to intervene on Legg's behalf; and negligently retained Jack and Doe's employment.

Legg is suing for compensatory and punitive damages. Matthew J. Woelfel is representing her.

The case has been assigned to Circuit Judge Carrie Webster.
