Couple sues Norfolk Southern Railway Company for injuries

WINFIELD -- A man and his wife are suing Norfolk Southern Railway Company for an accident that left him severely injured.

On May 8, 2009, two Norfolk employees "carelessly and negligently operated a railroad freight train" near Hometown in Putnam County in such a manner that caused it to collide with a commercial vehicle that Scott ones was a passenger in, according to a complaint filed Dec. 30 in Putnam Circuit Court.

Jones claims he sustained severe, permanent and lasting injuries to his upper extremities and shoulders, together with an organic brain injury, skull fracture and disfiguring lacerations to his head and face.

Jones claims the injuries have caused him to suffer physical pain and suffering, mental and emotional upset, aggravation, annoyance and inconvenience and loss of enjoyment of life. He claims he has incurred medical, hospital and doctor expenses in excess of $20,000.

Jones' wife, Sonya Jones, claims she has suffered a loss of care, comfort, companionship and consortium of her husband because of his injuries.

The Joneses are seeking compensatory damages. They are being represented by Harvey D. Peyton of the Peyton Law Firm.

The case has been assigned to Circuit Judge O.C. Spaulding.
