Couple sues GM for vehicle non-conformities

CHARLESTON -- A Kanawha County couple is suing General Motors after they claim the company did not conform to a vehicle warning.

On Sept. 1, 2006, Peter and Julie Schleider purchased a new 2007 Chevrolet Suburban from C&O Motors for $47,079.10, according to a complaint filed Feb. 16 in Kanawha Circuit Court.

The Schleiders claim after they purchased the new vehicle, they began to experience repeated non-conformities with the vehicle which substantially impaired its use and market value.

After a reasonable number of attempts, the manufacture did not conform the vehicle to the warranties, nor did it replace the vehicle with a comparable new one that did conform to the warranties, according to the suit.

The Schleiders claim as a result of the defendant's failure to conform the vehicle to the warranties, they were damaged by the loss of use of the vehicle and have further suffered annoyance, inconvenience and incurred expenses for alternative transportation.

The Schleiders are seeking for revocation of acceptance and refund of the purchase price, including but not limited to sales tax, license and registration and other reasonable expenses incurred for the purchase of the vehicle with interest; damages for the costs of repairs reasonably required to conform the vehicle to the express warranty and other incidental expenses; and damages for the loss of use, annoyance or inconvenience from non-conformity. They are being represented by Michael L. Glasser of Meyer, Ford & Glasser.

The case has been assigned to Circuit Judge Carrie Webster.
