HUNTINGTON -- An Ohio woman is suing C.R. Bard, Covidien and a Huntington obstetrician and gynecologist after she claims she was implanted with defective products.
Consuelo Jeffreys was implanted with the defendants' Ugytex polypropylene mesh and Avaulta Anterior and Posterior BioSynthetic Support Systems during a surgery performed by Mitchell E. Nutt at St. Mary's Medical Center, according to a complaint filed May 12 in Cabell Circuit Court.
The products were implanted to treat Jeffreys' pelvic organ prolapse, according to the suit.
Jeffreys claims that she has experienced significant mental and physical pain and suffering; has sustained permanent injury; permanent and substantial physical deformity; loss of a bodily organ system; and has undergone corrective surgeries as a result of the products.
The defendants had a duty to Jeffreys to use reasonable care in designing, manufacturing, marketing, labeling, packaging and selling the products and were negligent in doing so, according to the suit.
Jeffreys claims the products implanted in her were not reasonably safe for their intended use and were defective.
Nutt implanted the products in Jeffreys' body and performed certain procedures despite not having obtained her informed consent to do so, according to the suit.
Jeffreys is seeking compensatory and punitive damages. She is being represented by Robert R. Waters, Gary B. Blasingame and Henry G. Garrard III.
The case has been assigned to Circuit Judge David M. Pancake.
The defendants have been involved in multiple similar cases recently.
