* Hatcher and the defendants share a private road approximately one mile in length and are responsible for its maintenance and upkeep. On Sept. 9, 2009, Kramer and Binder hired Doe to use a bulldozer to widen the road, according to the suit. Hatcher claims he expressed concern that the work would cause the gravel on the road to fill up in the ditch line and cause erosion to the road and asked to be present when the work was performed to see that it was done satisfactorily, but the defendants had the work done at a time they knew he would not be there. Hatcher claims the road has eroded. He is seeking compensatory damages with pre- and post-judgment interest.
