Woman sues Lavalette PSD for negligence

WAYNE -- A Wayne woman is suing Lavalette Public Service District after she claims she was injured because of the company's negligence.

On Aug. 21, 2008, Betty Keeney was at Sherri's Special Occasions in Lavalette and was outside of the shop when she noticed a discarded coffee cup in the front yard of the shop, according to a complaint filed Aug. 18 in Wayne Circuit Court.

Keeney claims when she went to pink it up, her right foot slipped on the grass and onto a steel water cover lid, which flipped and caused her right foot and leg to slip into the hole underneath the lid.

The defendant had a duty to maintain the water lid in such a manner that it would not pose an unreasonable risk of injury to business invitees and licensees and breached this duty when it failed to adequately maintain the lid, according to the suit.

Keeney claims the defendant knew or should have known of the defect in that its representatives checked the water reading approximately once per month at the water lid's location.

Keeney is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Timothy P. Rosinsky.

The case has been assigned to Circuit Judge Darrell Pratt.
