CHARLESTON -- A Kanawha County woman is suing Michaels Stores after she claims it was negligent in allowing a shelf to fall and injure her.
On Oct. 5, 2008, Rebecca McComas was shopping in the defendant's Charleston store when two end caps containing glass and metal beads fell approximately two feet from a shelf, striking her in the head, according to a complaint filed Oct. 4 in Kanawha Circuit Court.
McComas claims the defendant was negligent and breached its duty of care and maintenance by allowing the shelf to be unsecured and/or become unsecured.
As a result of the defendant's negligent conduct, McComas sustained serious injury to her head; medical bills; loss of enjoyment of life; pain and suffering; emotional distress; and annoyance and inconvenience, according to the suit.
McComas is seeking compensatory and punitive damages. She is being represented by Paul M. Stroebel.
The case has been assigned to Circuit Judge Carrie Webster.
