Woman sues Kroger for injuries

CHARLESTON – A Kanawha County woman is suing Kroger after she sustained injuries at its Elkview location.

On Sept. 28, 2009, Alice Carol Vaughan was entering the Kroger store when she tripped over an empty pallet left in the area near the entrance, according to a complaint filed Jan. 21 in Kanawha Circuit Court.

Vaughan claims the defendant negligently allowed and permitted the empty pallet to remain on the floor for a period of time beyond which was required for its discovery and removal.

As a result of the defendants' carelessness and negligence, Vaughan sustained severe and painful injuries, according to the suit.

Vaughan is seeking compensatory damages. She is being represented by Charles R. Hughes.

The case has been assigned to Circuit Judge Tod J. Kaufman.
