Lincoln Co. man sues WVU Hospitals for negligence

MORGANTOWN – A man is suing West Virginia University Hospitals Inc. and unknown employees after he discovered a foreign object was left inside him about a surgery.

On Nov. 24, 2005, Daniel R. Adkins was involved in a car accident in which he fractured is acetabulum. He underwent an open reduction internal fixation of the fracture four days later, according to a complaint filed March 23 in Monongalia Circuit Court.

For the next three and one-half years, Adkins claims he suffered recurrent bladder and urinary tract infections, burning on urination and abdominal wall pain.

A cystoscopy revealed a foreign object was in Adkins' bladder, according to the suit, and on March 4, 2009, surgery was performed to remove the object, which was discovered to be coiled and knotted silicone tubing that was 66.5 cm long and 0.5 cm in diameter.

Adkins claims the tubing was left in during his surgery in 2005 by the defendants.

The defendants had a duty to perform competent surgical and other necessary procedures and failed to do so, according to the suit.

Adkins is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Frank Venezia, Brian L. Ooten and Kenneth P. Hicks.
