Man sues CAMC Teays Valley after receiving injuries

WINFIELD – A man is suing CAMC Teays Valley Hospital after he received injuries when his wheelchair turned over.

On May 26, 2009, Michael Allen Means was a business invitee of the defendant's and was receiving treatment for a problem with his ankle, according to a complaint filed May 26 in Putnam Circuit Court.

Means claims he was in a wheelchair and was exiting the vehicle to smoke a cigarette when he was directed to the designated smoking area.

The designated smoking area was on an incline and as Means parked the wheelchair in the area, the wheelchair was caused to turn over due to the incline, according to the suit.

Means claims he sustained a head injury, neck injury and back injury from the accident.

The defendant was negligent in properly maintaining the designated smoking area on its property, according to the suit.

Means is seeking compensatory damages with pre- and post-judgment interest. He is representing himself.

The case has been assigned to Circuit Judge O.C. Spaulding.
