Homeowners association sues individual for not paying dues

WINFIELD – Knights Court Homeowners Association is suing an individual for failure to pay homeowners association dues.

Alexander J. Ross, the escrow agent of and for Putnam County Bank, was also named as a defendant in the suit.

On May 20, 2004, Knights Court Homeowners Association placed a notice of lien for unpaid homeowners' association dues against Thomas E. Calabrese in the amount of $495 and on Dec. 14, 2005, the association placed another notice of lien in the amount of $2,190, according to a complaint filed Aug. 19 in Putnam Circuit Court.

The homeowners association claims Calabrese applied for a loan from Putnam County Bank and sought to encumber his real estate by means of a Deed of Trust.

At that time, the liens in favor of the plaintiff were found of record by Ross, the counsel for Putnam County Bank, according to the suit.

The homeowners association claims the sum of $6,525 was placed in escrow with Ross as the escrow agent, along with what was due to them for homeowners' association dues.

Calabrese has denied the validity of the liens and refused to allow the escrow agent to release the funds to the plaintiff, according to the suit.

As of July 2011, the defendants have failed to pay assessments in the about of $7,425, according to the suit.

Knight Court Homeowners Association is seeking damages in the amount of $7,425 with post-judgment interest. It is being represented by Lisa M. Moye.

The case has been assigned to Circuit Judge Philip Stowers.
