Woman sues St. Mary's Medical Center, doctor for injuries

HUNTINGTON -- A woman is suing St. Mary's Medical Center and a physician after she fell when attempting to exit an exam room.

On Aug. 27, 2009, Mattie S. Cosner was a patient of Dr. Timothy G. Saxe and St. Mary's Medical Center and was attempting to exit her exam room after her exam when she fell from an unmarked drop-off and/or unlevel flooring, according to a complaint filed Aug. 19 in Cabell Circuit Court.

Cosner claims the defendants failed to instruct, assist, monitor and provide proper instructions for her and failed to warn her of the unlevel flooring.

The defendants' negligence caused Cosner to sustain permanent physical injuries, including trauma to her left side and a fracture to her thigh bone, according to the suit.

Cosner is seeking compensatory damages. She is being represented by Mark H. Mitchell and Robert W. Absten.

The case has been assigned to Circuit Judge Paul T. Farrell.
