Mason man names 123 companies in asbestos suit

CHARLESTON -- A Mason man is suing 123 companies he claims are responsible for his mesothelioma diagnosis.

In March 2010, Delbert Chester Russell was diagnosed with mesothelioma, according to a complaint filed Sept. 6 in Kanawha Circuit Court.

Russell claims he has never smoked and was exposed to asbestos and/or asbestos containing materials during his employment from 1948 until 1993.

The defendants failed to protect Russell from the asbestos during his employment as an ironworker and coal miner, according to the suit.

Russell claims the defendants also failed to warn him of the dangers of asbestos.

The defendants are being sued based upon theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Russell is seeking a jury trial to resolve all issues involved. He is being represented by Victoria Antion, Scott A. McGee and Bronwyn I. Rinehart.

The case has been assigned to a visiting judge.
