Cabell woman sues Wayne Co. church for injuries

WAYNE -- A Cabell County woman is suing Salem United Baptist Church after she claims she sustained injuries at the church when she fell.

On Oct. 3, 2010, Frankie Smith was on the church's premises for the purpose of attending church services when she tripped and fell as a result of a dangerous, defective and hazardous condition in the doorway and/or doorway sill, according to a complaint filed Sept. 1 in Wayne Circuit Court.

Smith claims the defendant owed her the duty to exercise reasonable care and maintain its premises in a safe manner and free from hazards or defects that could cause injury to its invitees.

The defendant further owed Smith the duty to correct dangerous conditions on its premises, according to the suit.

Smith claims the defendant knew or should have known of the dangerous condition's existence.

The church was negligent in failing to correct the condition and failing to warn invitees of its existence, according to the suit.

Smith is seeking compensatory damages. She is being represented by Larry A. Bailey.

The case has been assigned to Circuit Judge Darrell M. Pratt.
