City National sues former state senator, husband

WINFIELD -- City National Bank of West Virginia is suing a former state lawmaker and her husband after it claims they stopped paying on a loan.

John Doe and John Doe Company were also named as defendants in the suit.

City National loaned former state Senator Lisa D. Smith and Mark Smith money for the purchase of a home and property of which they eventually stopped making payments for, according to a complaint filed Nov. 9 in Putnam Circuit Court.

The bank claims after the Smiths refused to make payments on the loan and Lisa Smith refused to leave the property, City National took the defendants to federal court and a foreclosure sale was conducted.

On Sept. 26, the Smiths were given notices of eviction, according to the suit.

City National claims on Nov. 8, it learned that timbering operations were being conducted on the property without the bank's permission.

City National is seeking compensatory and punitive damages. It is being represented by Ancil G. Ramey and Hannah C. Ramey.

The case has been assigned to Circuit Judge O.C. Spaulding.
