Woman blames Heritage Center for mother's wrongful death

HUNTINGTON -- A woman is suing Heritage Center after she claims the nursing home is responsible for her mother's death.

101 13th Street Operations, LLC is doing business as Heritage Center.

Genesis Healthcare, LLC was also named as a defendant in the suit.

Eva Frances Maiden was a resident of the nursing home from Dec. 29, 2009, until Jan. 13, 2010, according to a complaint filed Dec. 15 in Cabell Circuit Court.

Diana Carrier claims Maiden suffered from multiple falls that resulted in injury while at the nursing home.

Maiden also suffered uncontrolled hypertension, dehydration and acute renal failure while at the nursing home, according to the suit.

Carrier claims the defendants were negligent in carrying for her mother and caused her wrongful death.

The defendants breached their duties to the decedent, according to the suit.

Carrier is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart.

The case has been assigned to Circuit Judge F. Jane Hustead.
