Ohio woman sues nursing home for relative's death

CHARLESTON -- A woman is suing Health Care and Retirement Corporation of America after she claims it is responsible for the wrongful death of a family member.

Manor Care, Inc.; HCR Manorcare, Inc.; HCP West Virginia Properties, LLC f/k/a HCR Manorcare West Virginia Properties, LLC; Heartland Employment Services, LLC; and Joseph Donchatz were also named as defendants in the suit.

Health Care and Retirement Corporation of America is doing business as Heartland of Charleston.

Maria Louise Buckrem was a resident of the defendants from Oct. 28, 2009, until her death on Dec. 17, 2010, according to a complaint filed Dec. 9 in Kanawha Circuit Court.

Lazetta Dzurilla claims the defendants failed to provide Buckrem with sufficient hydration and nutrition.

On Dec. 11, 2010, Buckrem was moved to hospice care due to her deteriorating condition, according to the suit.

Dzurilla claims the defendants were negligent and breached the applicable standard of care owed to Buckrem, including a pattern of poor care, neglect and abuse.

The defendants were also negligent in causing the wrongful death on Buckrem, according to the suit.

Dzurilla is seeking compensatory and punitive damages. She is being represented by Damon Ellis and Jonathan R. Mani.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
