HUNTINGTON -- A man is suing Habitat for Humanity of West Virginia, Inc. for injuries he sustained on its property.
Habitat for Humanity of West Virginia is doing business has Huntington WV Area Habitat for Humanity ReStore.
On Feb. 18, 2010, Donald L. Sammons was injured on the defendant's property, according to a complaint filed Feb. 7 in Cabell Circuit Court.
Sammons claims the defendant had a duty to take reasonable precautions in order to eliminate risks which could be reasonably foreseen.
The defendant negligently violated its duties by failing to reasonably maintain its premises, according to the suit.
Sammons claims the defendant's premises were not maintained in a reasonably prudent manner in that heavy doors were stacked and stored on its premises in a way to constitute an "unreasonable risk of toppling onto patrons ..."
The defendant's negligent caused Sammons severe injuries, including injuries to his heart.
Sammons is seeking compensatory damages with pre-judgment interest. He is being represented by Paul A. Ryker.
The case has been assigned to Circuit Judge Paul T. Farrell.
