CHARLESTON – The hearing date for the Kanawha magistrate who allegedly dismissed cases in exchange for defendants doing favors for her has been set for June 6 in Supreme Court of Appeals courtroom at the state's Capitol Building in Charleston.
Court begins at 10 a.m., and Carol Fouty's case will be the second case of the day, according to a Supreme Court of Appeals press release.
Fouty was suspended without pay in April after an investigation was done regarding Fouty's housekeeper was arrested for driving under the influence while driving Fouty's car.
As per court rule, one television and still camera will be allowed in the courtroom on a first-come, first-serve basis and those photographers must agree to serve as a pool for others.
Photographers serving as pool camera must be in place before the first argument on the docket begins at 10 a.m. and remain in place until the second case ends, according to a Supreme Court of Appeals press release.
The hearing will be conducted pursuant to Rule 2.14 of the Rules of Appellate Procedure and the Judicial Disciplinary Counsel will be entitled to open and close the argument, as it is the petitioner.
