CHARLESTON -- A man is suing the State of West Virginia-Department of Highways and one of its employees after he claims he was injured due to the defendants' negligence.
On Sept. 9, 2010, Dimitri Lymon Beverly, an employee of the Department of Highways, was driving north on Interstate-77 in Charleston when he failed to maintain control of his vehicle by following too close and then struck the vehicle being driven by William Lockhart from behind and then continued north on Interstate-77 without stopping, according to a complaint filed June 7 in Kanawha Circuit Court.
Lockhart claims Beverly breached his duty of care to him when he failed to maintain control of his vehicle and caused him and his vehicle injuries.
As a result of of the defendants' negligence, Lockhart suffered injuries to his left hip, which affected his range of motion and caused him to walk with a limp; medical expenses; lost enjoyment of life; lost wages; and pain and suffering, according to the suit.
Lockhart is seeking compensatory damages. He is being represented by Henry E. Wood III.
