HUNTINGTON -- Construction Enterprises of the Tri-State is suing Huntington Alloys Corporation after it claims the company failed to pay for more than $600,000 owed for work performed.
Thistle Processing, LLC and Caledonian Alloys, Inc., were also named as defendants in the suit.
Construction Enterprises is doing business as Ross Brothers Construction Company.
In Spring 2011, Caledonian entered into an agreement with Ross Brothers to perform work on facilities owned, operated or maintained by the defendants, according to a complaint filed June 22 in Cabell Circuit Court.
The plaintiff claims Caledonian has refused and failed to pay for the work performed in the amount of $662,113.28.
Huntington Alloys, Caledonian and Thistle are joint ventures involved in processing, manufacture and sales of metal products at the Special Metals plant in Huntington, according to the suit.
The plaintiff claims it had a valid agreement with the defendants to perform work and to be paid for the work, but the defendants have refused to pay and are responsible for work performed in the amount of $615,261.25.
The plaintiff is seeking damages in the amount of $615,261.25 with pre- and post-judgment interest and punitive damages. It is being represented by Edward M. Kowal Jr. and Natalie Corrigan.
The case has been assigned to Circuit Judge David M. Pancake.
