CHARLESTON -- An Elkview couple is suing the owner of a local Long John Silver's for injuries sustained at its restaurant.
Faith DeLung an employee of Performance Foods, was also named as a defendant in the suit.
Performance Foods is doing business as Long John Silver's.
On June 1, Sharon Belcher was dining at Long John Silver's when she slipped and fell due to grease that was around her table, according to a complaint filed July 3 in Kanawha Circuit Court.
The defendants negligently and carelessly failed to maintain a clean area, causing Belcher's injuries, according to the suit.
Belcher claims the defendants failed to maintain its premises in a reasonably safe condition; failed to exercise due care in maintenance and inspection; failed to adequately train its personnel in the appropriate methods to inspect and maintain the premises; failed to warn of hazards; failed to exercise due care; and other acts and omissions.
The defendants' negligence and carelessness caused Belcher to suffer injuries and for her husband, Arthur Belcher, to suffer a loss of consortium of his spouse, according to the suit.
The Belchers are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Kathy A. Brown.
The case has been assigned to Circuit Judge Charles E. King.
