He cooked and attempted to eat one of the burgers and immediately felt pain in his throat but could not dislodge item. After seeking medical help, the item was found to be lodged in his thyroid. It was removed in a thyroid lobectomy and was shown to be a piece of steel wire measuring 2 cm. Plaintiff alleges negligence, liability and breach of warranty and seeks $48,342.91 for medical bills as well as additional amounts for lost wages and other punitive and compensatory damages. She claims negligence on the part of the defendant and seeks compensatory damages and other amounts to be determined by court. There were possible complications but patient was discharged May 29. On May 31, plaintiff was admitted as an emergency patient at Winchester Medical Center where an infection was found. Plaintiff was on ventilator and received excessive medical treatment and was finally released from hospital Aug. 11, 2010. Plaintiff alleges medical negligence and seeks monetary award for an amount to be determined but not to be less than $100,000 as well as costs and other fees.
