Man accuses Seventeenth Street Associates of negligent care at nursing home

HUNTINGTON -- A man is suing Seventeenth Street Associates for failing to care for his family member while she was in its nursing home.

Seventeenth Street Associates is doing business as Huntington Health and Rehabilitation Center.

Anna Ruth Clagg was a resident at the nursing home from June 23, 2010 until Feb. 22, according to a complaint filed July 18 in Cabell Circuit Court.

Charles Chapman claims while in the nursing home, Clagg suffered from skin tears, bruising, pain and lacerations/contusions to her head, as well as an extensive open left ankle fracture which ultimately led to an above the knee amputation.

The defendant were negligent in caring for Clagg and caused her severe and permanent injuries, according to the suit.

Chapman claims the defendant failed to ensure that a resident care plan was developed, implemented, maintained and documented with regard to proper skin integrity of Clagg and other care for her.

The defendant also failed to ensure Clagg "maintained implement proper interventions to prevent falls with injury," according to the suit.

Chapman is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge David M. Pancake.
