Man sues Speed Mining for wage payment violations

CHARLESTON -- A former employee is suing Speed Mining, LLC after he claims it failed to pay his final wages within 72 hours of terminating his employment.

Brian Keith Anderson was employed by Speed Mining until his discharge on June 20, according to a complaint filed July 31 in Kanawha Circuit Court.

Anderson claims he did not receive his final wages until June 30 when he received a check dated June 27.

On June 29, Anderson also received a package of discharge papers concerning his employment release dated June 27 that explained the discharge of his benefits, according to the suit.

Anderson claims the defendant failed to pay his final wages in a timely manner, which violated the West Virginia Wage Payment and Collection Act.

Anderson is seeking damages in the amount of $13,163.40. He is representing himself.

The case has been assigned to Circuit Judge Jennifer Bailey.
