CHARLESTON -- A man is suing Logan's Roadhouse after he slipped and fell in its restroom and was injured.
Douglas Rent and Elizabeth Keating, employees at Logan's, were also named as defendants in the suit.
On Aug. 27, 2010, Jerry McGhee was on the defendants' premises as a guest, according to a complaint filed Aug. 22 in Kanawha Circuit Court.
McGhee claims when he went to the restroom area, he slipped and fell to the floor, which caused him substantial physical injuries.
There were no visible warnings indicating that the floor had been freshly mopped in the restroom when McGhee entered it, according to the suit.
McGhee claims Rent and Keating had a duty to adequately oversee, control and supervise others so as to ensure the safety of guests and visitors upon the premises and their negligence and failure to do so caused his injuries.
As a result of the defendants' negligence, McGhee has sustained pain and suffering; loss of wages; medical, surgical and related expenses; emotional distress, loss of enjoyment of day-to-day activities, annoyance and inconvenience; and other damages, according to the suit.
McGhee is seeking compensatory damages. He is being represented by Mark McMillian.
The case has been assigned to Circuit Judge Carrie Webster.
