CHARLESTON -- A woman is suing West Virginia’s Choice, Inc. and Mulberry Street Management Services, Inc. for violating the West Virginia Wage Payment and Collection Act.
Carol King was employed by the defendants as a Homemaker Aide, according to a complaint filed Sept. 5 in Kanawha Circuit Court.
King claims the defendants are required to pay employees in accordance with the Minimum Wage and Maximum Hours Standards and violated these standards.
The defendants are required to pay compensation for employment in excess of 40 hours per week at a rate of no less than one and one-half times the regular rate at which each employee is employed, according to the suit.
King claims the defendants failed to pay her for hours worked in excess of 40 hours per week at the correct rate.
All persons employed by the defendants in West Virginia within the two calendar years immediately preceding the date of the complaint who were not paid for hours worked in excess of 40 hours per week at a rate of one and one-half times each employee’s regular rate are members of the proposed class in the suit, according to the suit.
King is seeking compensatory damages. She is being represented by Cameron S. McKinney and David L. Grubb.
The case has been assigned to Circuit Judge James C. Stucky.
