Former employee accuses Drug Testing Centers of wage payment violations

CHARLESTON – A former employee is suing Drug Testing Centers of America Charleston Corporation after she claims it violated the West Virginia Wage Payment and Collection Act.

Sheilah Finch was employed by the defendant from January 2011 until May 16, according to a complaint filed Oct. 1 in Kanawha Circuit Court.

Finch claims the defendant failed to pay her final wages in full within 72 hours of her discharge.

The defendant did not give Finch her final wages until May 25, according to the suit, which violates the West Virginia Wage Payment and Collection Act.

Finch claims the defendant’s actions entitle her to treble damages.

The defendant’s failure to pay her employment wages in a timely manner also violated West Virginia Code, according to the suit.

Finch is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega.

The case has been assigned to Circuit Judge Carrie Webster.
