CHARLESTON -- A Logan County man is suing General Motors, LLC, after he claims the vehicle he purchased was defective.
On Feb. 19, 2011, Jeromey Crum purchased a new 2011 Chevrolet Silverado from the defendant in the amount of $52,219, according to a complaint filed Sept. 18 in Kanawha Circuit Court.
Crum claims after purchasing the new vehicle, he experienced repeated non-conformities which substantially impaired the use and market value of the vehicle.
After a reasonable number of attempts, the manufacture did not conform the new motor vehicle to the warranty, nor replace the vehicle with a comparable new motor vehicle which did conform to the warranties, according to the suit.
Crum claims as a result of the defendant’s failure to conform to the vehicle’s warranties, and after a reasonable number of attempts, he was damaged by the loss of use of the vehicle and has suffered annoyance, inconvenience and incurred expenses for alternative transportation.
The defendant’s actions violated West Virginia code, according to the suit.
Crum is seeking revocation of acceptance and refund of the purchase price of the vehicle; repair costs; and damages for loss of use, annoyance or inconvenience. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Charles E. King.
