CHARLESTON – A woman is suing Big Sandy Furniture, Inc., after a piece of furniture allegedly fell and struck her.
Jon Conrad and John Doe were also named as defendants in the suit.
On Feb. 2, Helen Dolin was on the defendants’ property when a trundle bed fell and struck her, according to a complaint filed Dec. 7 in Kanawha Circuit Court.
Dolin claims Big Sandy had an affirmative duty to examine the premises for unsafe or dangerous conditions; warn business invitees as to any unsafe or dangerous conditions; correct any unsafe or dangerous conditions; and otherwise keep and maintain the premises in a safe condition.
Conrad and Doe negligently placed the trundle bed standing on its end on Big Sandy’s premises, which was not stable and was subject to falling over onto customers, according to the suit.
Dolin claims the trundle bed was heavy and created an unreasonably unsafe, dangerous and latent condition which was not readily recognizable by a customer.
The defendants’ actions caused Dolin to suffer temporary and permanent injuries to her body; incur medical bills to treat her injuries; physical pain and suffering; mental anguish and emotional distress; and loss of enjoyment of life, according to the suit.
Dolin is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Marvin W. Masters and Paula L. Wilson.
The case has been assigned to Circuit Judge James C. Stucky.
