CHARLESTON – A couple is suing Millennium Group, LLC, for allegedly negligently installing the roof on their residence.
In 2004, Alfred Atkinson and Stella Atkinson and Millennium entered into a contract for the construction of a home, according to a complaint filed Dec. 17 in Kanawha Circuit Court.
The Atkinsons claim in February they discovered the roof of the premises was not installed appropriately, which was in breach of their contract.
The roof was installed in violation of the warranty that it would be constructed in good and workmanlike manner and was in violation of the contractual warranty of habitability, according to the suit.
The Atkinsons claim the defendant’s negligence also was a breach of the contract and caused them to suffer damages.
The Atkinsons are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Timothy J. LaFon.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
