Mike Enyart & Sons, Miss Utility of West Virginia settle negligence lawsuit

CHARLESTON - A lawsuit against Mike Enyart & Sons Inc. and Miss Utility of West Virginia Inc. was settled and dismissed in April 2012.

David Bray and Terri Bray filed the suit on Feb. 10, 2011, claiming in March 2010, Enyart engaged in busting and removing asphalt on the roadway on 87th Street in Marmet near their home.

The Brays claimed soon after, they began to experience cracks and other problems in their home that had not previously been there.

On April 20, a Full and Final Order of Dismissal was filed in Kanawha Circuit Court stating the parties jointly moved the Court to dismiss the complaint with prejudice, as compromised, settled and agreed.

A mediation was held on April 2 in which the claims in the case were successfully settled, according to a letter filed April 3 by G. Patrick Jacobs of Jacobs Law Office, the plaintiffs' attorney.

Andrew P. Ballard of Campbell Woods represented Mike Enyart & Sons.

The case was assigned to Circuit Judge Louis Bloom.
