HUNTINGTON – A Kentucky woman has settled her 2011 lawsuit against St. Mary’s Medical Center days before it was originally scheduled to go to trial.
Tiffany A. Halley sued St. Mary’s on May 12, 2011, in U.S. District Court for the Southern District of West Virginia in Huntington. On April 19, the two sides notified Judge Robert C. Chambers that they had reached a settlement.
Terms of the settlement were not disclosed. Halley was represented by Bert Ketchum of Greene Ketchum Bailey Walker Farrell & Tweel in Huntington.
The complaint did not include specific allegations, only that St. Mary’s negligently rendered health care services to Halley and caused significant personal injuries and damages on April 13, 2009.
“Defendant, SMMC, acting by and through its agents, servants or employees, deviated from the standard of care by failing to exercise that degree of care, skill and learning required or expected of reasonable, prudent health care providers in the profession or class to which the health care provider belongs acting in the same or similar circumstances during the care and treatment of Plaintiff,” the complaint says.
On March 11, Halley and St. Mary’s informed Chambers of a pending settlement. He stayed the case to allow the parties submit an agreed order of dismissal within 30 days.
Before the stay, a trial was scheduled to begin April 23.
St. Mary’s was represented by Randall L. Saunders of the law firm Nelson Mullins Riley & Scarborough in Huntington.
