Woman blames Embassy Suites for fractured pelvis

Embassy

CHARLESTON - A guest at Embassy Suites is suing the hotel after she alleges she was injured when she slipped in a bathtub.

Atrium TRS V LLC is doing business as Embassy Suites.

On Aug. 12, Cheryl Williams was a guest at Embassy Suites and was in her guest room when she slipped and fell in the bathtub and was injured, according to a complaint filed June 21 in Kanawha Circuit Court.

Williams claims the bathtub was not equipped with any safety devices, such as rubberized or abrasive material on the floor of the tub that would have made the surface less slippery and less of a hazard to hotel guests.

As a result of her fall, Williams suffered a fractured pelvis, intense lingering pain, mental suffering and loss of ability to enjoy life, according to the suit.

Williams claims the defendant breached its duty by neglecting to adequately equip the bathtub in her room with devices such as adhesive or rubberized material designed to minimize the risks of slips and falls.

As a direct and proximate result of the defendant's breach of duty, Williams suffered physical injuries, intense pain, mental suffering and loss of the ability to enjoy life and sustained damages, according to the suit.

Williams is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Harry F. Bell Jr. and Jonathan W. Price of the Bell Law Firm PLLC.

The case has been assigned to Circuit Judge Tod J. Kaufman.
