AG's office reaches $5.75M settlement with Nationwide

WELCH - A $5.75 million settlement has been issued in a lawsuit against Nationwide Insurance that was filed by the attorney general in 2013.

By paying the $5.75 million settlement, Nationwide is released from any and all liability in West Virginia arising out of or related to the Farm Bureau discount and/or any and all claims asserted in the lawsuit, according to the settlement agreement.

The 2013 lawsuit was originally filed by former Attorney General Darrell McGraw and was taken over by Patrick Morrisey when he took office.

Nationwide was accused of violating state laws in the lawsuit.

"Our office is pleased to announce that we have been able to come to an agreement with Nationwide on this matter on behalf of the citizens of West Virginia," Morrisey said in a press release. "Our agreement will help to ensure that Nationwide customers in West Virginia recoup funds they may not have previously received and brings closure to this issue in the state."

Of the $5.75 million, approximately $3.6 million will go to the Attorney General's office and the remainder will go toward attorneys' fees and restitution to affected consumers.

Nationwide denied it violated state laws and the settlement does not include any admission of fault.

The case was assigned to Circuit Judge Booker T. Stephens.
